Sherlock Anti-Theft Marking Inc. (“Sherlock”, “we”, “us”) is committed to taking the necessary measures to comply with the principles and requirements for the protection of privacy and personal information under applicable legislation. This policy (the “Policy”), applies to services offered by Sherlock under the domain www.sherlock.ca/ (the “Site”).

Your privacy is our main concern. Our goal is to ensure the confidentiality and security of the personal information you provide to us and to protect this information in accordance with applicable privacy laws. This Policy explains our privacy and security practices. In this Policy, personal information refers to information that can identify an individual, directly or indirectly.

By continuing to browse our Site, you agree and consent to the practices described in the Policy. If you do not agree with it, we ask you not to use our Site.

Personal information collected and purposes

In the course of our business, we may collect personal information from you. We only collect personal information that is necessary to provide you with our various services. Where possible, we indicate both mandatory and optional fields.

We collect personal information about you:

  • when you contact us (by email, telephone, mail, through our chat tool or in person), we may collect your name, email address, address and phone number. This information allows us to provide the requested information or services and communicate with you regarding your contact request;
  • when you obtain an Anti-Theft Intensive MarkingTM or when you wish to certify the integrity of the marking in order to obtain a certificate in your name, we collect the necessary information in order to provide you with our anti-theft service and issue your certificate. This information includes your name, address, phone number, email, information about your insurance policy, and information about your vehicle including the serial number. If you obtain our product directly from our offices, we may also collect the banking information necessary for the transaction.
  • when you subscribe to our newsletter, we will collect your name and email address in order to send you promotional emails about our activities and promotions that may interest you. You can choose to change your preferences by following the “unsubscribe” link provided at the end of the email or communication received. We use this information to provide information about current and future products and services or other developments concerning our business;
  • when you use our job application function for a job offer or an unsolicited application posted on our Site, we will collect your name, email address and any other information you provide, including your employment history. We use this information to evaluate and respond to your application; and
  • when you visit our Site, automatically collect information about you through cookies. Cookies are information sent to your computer or any similar device you use to access the internet, such as a smartphone, tablet or other mobile device, when you visit a website, which store and sometimes track information about your use of the site. Generally, personal information about you will be collected directly from you. However, we may collect personal information from third parties as permitted by law.

We may also collect personal information in order to comply with applicable legal and regulatory requirements, or for other purposes permitted by law. We do not collect personal information for other purposes unless we obtain the consent of the individual.

How is your personal information used or disclosed?

We only use or disclose personal information to the extent reasonably necessary to facilitate the purposes listed above. If you have obtained an Anti-Theft Intensive Marking, we may share your personal information with Canadian and international law enforcement agencies (such as Interpol), the Canada Border Services Agency, and the Équité Association and your insurance company.

We may share your personal information with third party service providers who perform functions on our behalf, including dealers, mechanics and glaziers, IT service providers, of data hosting or analysis or marketing services.

We may also disclose your information in connection with a business transaction, in connection with the financing, securitization, insurance, sale, assignment or other proposed or actual disposition of all or any portion of Sherlock, or its businesses or assets, for the purpose of evaluating and/or executing the proposed transaction. Transferees or successors of Sherlock, or its business or assets, may use and disclose your personal information for purposes similar to those described in this Policy.

Finally, your information may be disclosed if it is necessary to meet legal, regulatory or other insurance, audit and security requirements, and otherwise with your consent, or as permitted or required by law (including as required by applicable Canadian and foreign laws applicable to us or our service providers).

We do not sell your personal information to third parties. Your personal information is only distributed without your consent to the extent permitted or required by law.

Security and storage of your personal information

We will maintain the confidentiality of your information and it will only be used in accordance with this Policy or applicable laws. Our internal practices help protect your privacy by limiting employee access to and use of customer data.

We have implemented reasonable security measures to protect against the theft, loss, misuse or alteration of your personal information, such as the implementation of firewalls and encryption technologies, as well as the restriction of access to personal information only to employees who really need it.

The protection of personal information is particularly important to us and we are prepared to take appropriate and timely measures in case of an incident involving them, in accordance with applicable privacy laws.

We retain personal information as long as necessary to fulfill the purposes for which it was collected, or for legal or business purposes. When your personal information is no longer required, we destroy or anonymize your personal information for use at a later date in accordance with applicable laws.

Hosting and transfers of personal information

We will retain personal information on our internal servers or with service providers. Personal information collected about you may be stored and/or processed outside of Quebec. Our service providers may store and process personal information outside of Quebec or Canada. Where information is stored or processed outside of your jurisdiction, it may be subject to the laws of and accessible by judicial authorities in those other jurisdictions. We ensure that our service providers comply with all applicable privacy laws, and implement contractual clauses imposing obligations on them. Cookies and IP addresses

Visitors to our website should also be aware that anonymous technical data may be collected during their visit to our site. They may include the visitor’s IP address, browser and operating system type, domain name, access times and referring website addresses. We use this data to identify an individual, gather broad demographic information about website users, diagnose problems with our systems and administer the website.

We will not attempt to link or match this anonymous technical data with personally identifiable information, unless we (or our service providers) have obtained your consent or as required by applicable laws.

We use analytics cookies to analyze how visitors use our websites and to monitor the performance of our websites. This allows us to ensure a high-quality experience by customizing our offer. For example, we may use analytics cookies to track which pages are most popular, determine the most effective way to link pages together, and determine why certain pages receive error messages. The data collected by these cookies will not be associated with your personal information either by us or by our subcontractors.

Our Site may contain links to other third party websites that may collect personal information. This policy does not include the privacy practices of these third parties (or the absence thereof). We cannot and will not be responsible for the policies, practices and actions of these third parties.

If you obtain the KYCS Locate tracking service, we are not responsible for any information that may be collected in connection with such service. For more information about KYCS’s collection, use or disclosure of your personal information, please refer to their privacy policy.

What are your rights related to your personal information?

We appreciate your help in keeping your personal information up to date and accurate. You have the right to access, review, amend and correct your personal information collected by us. To access, verify, correct or update your personal information, please contact our privacy officer using the contact information provided at the end of this Policy.

In some cases, applicable laws may require us to refuse to give you access to any or all of the personal information we hold about you, or that we may have destroyed, deleted or anonymized in accordance with our legal record retention obligations and best practices for the protection of personal information. If we are unable to provide you with access to your personal information, we will notify you of the reasons for this, subject to any legal or regulatory restrictions.

You may refuse or withdraw your consent to the collection, use and disclosure of your personal information, or request deletion of any personal information we hold about you, at any time upon reasonable notice, subject to any legal or contractual requirements. However, if consent is refused or withdrawn, we may not be able to provide certain services. We will explain the consequences of removing your information or withdrawing your consent once your request is received in order to assist you with your decision.

Date of entry into force and modification

This policy, as amended from time to time, was adopted by Sherlock on the last update date listed above. We reserve the right to change this policy at any time. If we intend to use or disclose personal information for a purpose materially different from that described in this Policy, we will make reasonable efforts to notify you, including by posting the revised Policy on our Site. By continuing to provide personal information or use our site after any changes are made to this Policy, you agree to such changes.
